What Is a Warrant Canary? Transparency Explained

A warrant canary is a statement by a company that it has NOT received secret surveillance orders. When the canary disappears, users know the company has been served—even when gag orders prevent direct disclosure.

How Warrant Canaries Work

Companies regularly publish statements confirming they have not received National Security Letters or FISA orders. If they receive one, they remove the statement rather than lying about it. The absence of the canary signals government surveillance.

Legal Basis

While companies can be compelled to secrecy about surveillance orders, they cannot be compelled to lie. Removing a previously published statement is not considered disclosure. This legal theory, while untested in court, is widely used.

Limitations of Warrant Canaries

Canaries only signal that something happened—not what, when, or about whom. They may be removed slowly or quietly. Some legal experts question whether courts would uphold the distinction between lying and removing a statement.
